Intellectual Property
1. Policy Statement
Buletin Ilmiah Nagari Membangun is committed to protecting intellectual property rights, respecting authorship, promoting responsible scholarly communication, and ensuring transparent copyright and licensing arrangements.
The journal operates as an open-access scholarly publication and recognizes the importance of making knowledge generated through community engagement and community development activities accessible to researchers, practitioners, institutions, and the wider public.
This policy addresses copyright ownership, publication licensing, authors' rights, third-party materials, prior dissemination, plagiarism, and the responsible use of intellectual property.
The policy is informed by the Committee on Publication Ethics (COPE) Core Practices, particularly those concerning intellectual property, transparency, and publication integrity.
2. Definitions
Intellectual Property: Creations of the mind, including scholarly manuscripts, original illustrations, photographs, educational materials, software, designs, and other works that may be protected under applicable intellectual property laws.
Copyright: The legal rights associated with original works of authorship, subject to applicable law.
Open Access: A publishing model in which scholarly articles are made freely accessible online, with reuse governed by the applicable license.
Creative Commons License: A standardized public license specifying the conditions under which copyrighted material may be shared, reused, and adapted.
Third-Party Material: Content incorporated into a manuscript whose rights are held by someone other than the manuscript authors.
Version of Record: The formally published version of an article maintained by the journal.
3. Copyright Ownership
Authors publishing in Buletin Ilmiah Nagari Membangun retain copyright in their original scholarly contributions, as reflected in the copyright notices displayed on the journal's published articles.
Authors remain responsible for ensuring that they hold the necessary rights or permissions to publish the material included in their manuscripts.
The journal and its publisher are recognized as the original publisher of articles accepted and published through the journal.
Authors should ensure that publication arrangements are consistent with the journal's applicable copyright notice and licensing terms.
Copyright ownership of materials contributed by employers, institutions, community partners, or other third parties must be determined according to applicable law and relevant agreements.
4. Publishing License
Articles published in Buletin Ilmiah Nagari Membangun are distributed under the Creative Commons Attribution-ShareAlike 4.0 International License (CC BY-SA 4.0), as indicated in the journal's published article records.
The license text is available at:
https://creativecommons.org/licenses/by-sa/4.0/
Under CC BY-SA 4.0, users may:
-
Share: Copy and redistribute licensed material in any medium or format.
-
Adapt: Remix, transform, and build upon licensed material, including for commercial purposes.
These permissions are subject to the license conditions:
Attribution (BY)
Users must provide appropriate credit, identify the source, link to the applicable license, and indicate whether changes were made.
Attribution should not imply that the original authors or the journal endorse the reuse.
ShareAlike (SA)
When users share adapted material, they must distribute their contributions under the same license or a compatible license permitted by CC BY-SA 4.0.
No Additional Restrictions
Users must not impose legal terms or technological measures that legally restrict others from exercising the rights granted by the license.
The license applies only to material for which the relevant rights holder has authority to grant those permissions.
5. Rights of Authors
Subject to applicable copyright arrangements and the rights of third parties, authors may reuse and disseminate their own published scholarly work.
Permitted activities may include:
-
Sharing the published article on personal or institutional websites.
-
Depositing appropriate article versions in repositories.
-
Distributing copies for teaching and scholarly communication.
-
Reusing portions of their work in subsequent publications with appropriate citation.
-
Presenting and discussing published findings at academic or professional events.
-
Sharing articles with community partners and organizations involved in the reported activities.
Authors should acknowledge the original publication in Buletin Ilmiah Nagari Membangun, including the article title, journal name, publication details, and DOI where available.
Authors must also respect any rights belonging to collaborators, institutions, or third-party copyright holders.
6. Responsibilities of Authors
Authors are responsible for ensuring that their manuscripts do not infringe the intellectual property rights of others.
Authors must:
-
Submit original scholarly work.
-
Properly acknowledge ideas, text, data, and materials obtained from other sources.
-
Obtain necessary permissions for protected third-party materials.
-
Disclose relevant prior dissemination.
-
Avoid plagiarism and misleading duplication.
-
Respect confidentiality and intellectual property agreements.
-
Provide accurate information about copyright ownership and permissions.
-
Cooperate with reasonable editorial inquiries concerning intellectual property.
Authors must not assume that material freely accessible online is necessarily free of copyright restrictions.
7. Third-Party Copyrighted Materials
Manuscripts may contain photographs, figures, tables, maps, diagrams, questionnaires, training materials, or other content created by third parties.
Authors must determine whether such materials can lawfully be reproduced, adapted, and distributed under the intended publication arrangements.
Where necessary, authors must obtain permission from the relevant copyright holder before submission.
Permissions should cover the intended publication and reuse, including distribution under the journal's open-access license where applicable.
If third-party material is included under a different license or permission, the manuscript must clearly identify that material and its applicable terms.
Material excluded from the article's Creative Commons license must be clearly marked.
The journal may request evidence of relevant permissions.
8. Intellectual Property in Community Engagement Activities
Community engagement activities may produce materials with intellectual property interests extending beyond the manuscript itself.
Examples include:
-
Training modules and educational resources.
-
Community development manuals.
-
Software applications and digital platforms.
-
Technical designs and prototypes.
-
Product designs and branding materials.
-
Photographs and audiovisual documentation.
-
Traditional or local knowledge.
-
Databases and evaluation instruments.
-
Other materials developed collaboratively with community partners.
Publication of an article describing these materials does not automatically transfer ownership of the underlying intellectual property to the journal.
Authors must respect applicable agreements governing the ownership, use, disclosure, and commercialization of project outputs.
Where a manuscript describes intellectual property belonging to a community partner or institution, authors should obtain the necessary authorization to disclose protected material.
9. Traditional Knowledge and Community Contributions
The journal recognizes that community engagement publications may draw upon local practices, traditional knowledge, cultural expressions, and knowledge contributed by community members.
Authors must treat such contributions respectfully and avoid misappropriation or misleading claims of ownership.
Where relevant, authors should:
-
Identify the source of knowledge appropriately.
-
Obtain necessary permissions or agreements.
-
Respect confidentiality and cultural sensitivities.
-
Acknowledge the contributions of community members.
-
Avoid publishing restricted knowledge without authorization.
-
Consider whether contributors qualify for authorship under the journal's Authorship and Contributorship policy.
Publication under an open-access license must not be used to override rights or restrictions that authors are not legally entitled to waive.
10. Photographs, Videos, and Audiovisual Materials
Authors must ensure that photographs, videos, and other audiovisual materials included in manuscripts are used lawfully and ethically.
Copyright permission and consent for publication of identifiable individuals are separate requirements.
Permission from the copyright holder of a photograph does not necessarily establish that the individuals depicted have consented to publication.
Similarly, participant consent does not automatically establish ownership of the photograph.
Authors must address both requirements where applicable.
The journal may request clarification or supporting documentation concerning the use of identifiable or third-party audiovisual materials.
Further requirements are addressed in the journal's Ethical Oversight policy.
11. Plagiarism and Intellectual Property Infringement
The journal does not accept plagiarism, unauthorized copying, or the misrepresentation of another person's intellectual contributions.
Potential violations include:
-
Reproducing text without appropriate acknowledgment.
-
Using another person's figures, photographs, or tables without lawful authorization.
-
Presenting another person's ideas or project outputs as original work.
-
Reusing substantial portions of previously published material without adequate disclosure.
-
Misrepresenting ownership of community-developed materials.
-
Publishing protected or confidential information without authorization.
Suspected violations will be assessed fairly and in accordance with the journal's Plagiarism Policy and Allegations of Misconduct policy.
Textual similarity alone does not establish plagiarism. The journal will consider attribution, context, the nature of the overlap, and relevant evidence.
12. Prior Dissemination and Prepublication
Authors must disclose relevant prior dissemination of a manuscript or substantially related work.
Prior dissemination may include:
-
Theses or dissertations.
-
Conference abstracts or presentations.
-
Institutional reports.
-
Preprints or working papers.
-
Community engagement project reports.
-
Repository deposits.
-
Previously published articles.
Prior availability does not necessarily constitute disqualifying duplicate publication.
The editorial team will assess the nature and extent of prior dissemination against the journal's originality requirements and submission policies.
Authors must provide appropriate references and explain any substantial overlap.
The journal's Author Guidelines and Repository Policy should clearly specify which forms of prior dissemination are permitted and whether any conditions apply.
13. Repository Deposit and Self-Archiving
The journal supports responsible dissemination of published scholarship through appropriate repositories and academic platforms.
Authors may share material in accordance with the copyright and license applicable to the relevant article version.
For articles published under CC BY-SA 4.0, the licensed Version of Record may be redistributed subject to the applicable license terms, including attribution and ShareAlike requirements.
The terms applicable to submitted manuscripts, accepted manuscripts, and third-party materials may differ.
Authors should clearly identify the version deposited and provide a link to the formal journal publication where available.
Detailed arrangements for article versions, repository locations, and any journal-specific conditions should be addressed in the separate Repository Policy.
14. Copyright of Peer-Review Reports
Peer-review reports may constitute original works protected by copyright.
The journal must respect applicable rights associated with review reports while maintaining the confidentiality of its peer-review process.
Reviewers must not disclose unpublished manuscripts or use confidential information for unauthorized purposes.
Publication or wider distribution of identifiable reviewer reports should not occur without an appropriate legal basis and any necessary permissions.
Any policy concerning public peer-review reports must remain consistent with the journal's Peer-Review Processes policy.
15. Journal Name, Logo, and Publishing Materials
The journal's name, logo, website design elements, and other original publishing materials may be subject to applicable intellectual property protections.
Their use must comply with the rights of the relevant owners and applicable law.
The Creative Commons license applied to journal articles does not automatically authorize the use of the journal's logo, trademarks, or other separately protected materials.
16. Intellectual Property Disputes
Concerns about copyright infringement, unauthorized reproduction, disputed ownership, or misuse of intellectual property may be reported to the editorial office.
The journal will assess credible concerns using an appropriate and proportionate process.
Depending on the circumstances, the journal may:
-
Request clarification from the parties concerned.
-
Examine copyright notices, permissions, and relevant agreements.
-
Seek additional documentation.
-
Request correction or replacement of problematic material.
-
Refer complex ownership disputes to the relevant institution or competent authority.
-
Publish a correction or other appropriate notice.
-
Consider retraction when the circumstances justify that action under applicable publication ethics guidance.
The journal does not act as a court or automatically determine ownership in complex legal disputes.
Editorial action will focus on protecting the integrity and lawful dissemination of the scholarly record.
17. Post-Publication Intellectual Property Concerns
If a credible intellectual property concern is identified after publication, the journal will evaluate its implications for the published article.
An infringement involving a particular image or figure may be addressed differently from extensive plagiarism or a fundamental misrepresentation of ownership.
Where appropriate, the journal may correct an article, replace or remove specific material with a transparent notice, or take other publication-related action.
Retraction will be considered when justified by the seriousness of the concern and relevant publication ethics guidance.
Actions affecting the published record will be handled in accordance with the journal's Post-Publication Discussions and Corrections policy.
18. Transparency of Copyright and Licensing Information
The journal should ensure that authors and readers can readily identify:
-
Who holds copyright in the published article.
-
Which Creative Commons license applies.
-
The rights granted to readers and other users.
-
Any third-party material excluded from the article license.
-
The conditions for lawful reuse and attribution.
-
The journal's relevant copyright and repository policies.
Copyright and licensing information should be consistent across article landing pages, PDF files, author instructions, and other relevant publication records.
The journal should correct inconsistencies when identified.
